First: Great commentary with lots of good arguments! 
However, your outline of the copyright holders' missing SWOT analysis is as sloppy as the analysis you are accusing them of not having done: When you are holding up Pirate Bay's Strengths and Weaknesses in the same SWOT as the copyright holders' Opportunities and Threats, it's like comparing apples and apple-eating caterpillars. 
This is picky, I know, but such accusations should be valid.
